Terms of Service

By accessing or using any MariyamTech LLC product, website, or service (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization.

MariyamTech LLC is incorporated in California, USA. These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-law provisions.

MariyamTech LLC provides the following SaaS products:

• NovaSend — Transactional email and SMS API platform
• FormVault — Drag-and-drop web form builder with encrypted submission storage
• LinkTrackr — URL shortener and click analytics platform
• Media Player — Cross-platform video player (sold as a one-time lifetime license)

We reserve the right to modify, suspend, or discontinue any part of the Services with reasonable notice. We are not liable to you or any third party for any modification, suspension, or discontinuation.

You must create an account to use most MariyamTech Services. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your password and account credentials
• Notify us promptly at support@mariyatech.com of any unauthorized access
• Accept responsibility for all activity that occurs under your account

You agree not to use the Services to:

• Send unsolicited commercial messages (spam) via NovaSend
• Collect personal data without appropriate consent via FormVault
• Create short links that redirect to phishing, malware, or deceptive content via LinkTrackr
• Violate any applicable law, regulation, or third-party rights
• Attempt to gain unauthorized access to our systems or networks
• Resell or sublicense our Services without written permission

We reserve the right to suspend or terminate accounts that violate these policies without refund.

Paid plans are billed monthly. The Media Player is a one-time lifetime purchase. All payments are processed by Stripe, Inc. MariyamTech LLC does not store, process, or have access to raw payment card data.

Subscriptions auto-renew at the end of each billing cycle unless cancelled. You may cancel at any time from your account dashboard. Cancellation takes effect at the end of the current billing period.

We offer a 14-day refund window on paid plans as described in our Refund Policy.

All content, software, designs, and trademarks on our Services are the exclusive property of MariyamTech LLC or our licensors. You may not reproduce, distribute, modify, or create derivative works without our prior written consent. You retain ownership of any data or content you submit through our Services.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MARIYAMTECH LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES.

OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) $100 USD OR (B) THE AMOUNT YOU PAID TO MARIYAMTECH IN THE 12 MONTHS PRECEDING THE CLAIM.

Either party may terminate these Terms at any time. Upon termination, your right to access the Services ceases immediately. We will retain your data for 30 days after termination unless you request earlier deletion. Provisions that by their nature should survive termination shall survive, including intellectual property rights, disclaimers, and limitations of liability.
